Terms and Conditions
1. General
These Terms and Conditions apply to all sales of goods by Ink and Stitch (referred to as “the Company”) to all customers, excluding all other terms, conditions, and warranties unless explicitly agreed in writing by an authorised representative of the Company. Placing an order signifies the Buyer’s complete acceptance of these Terms. Any variation must be confirmed in writing by an authorised Owner of the Company.
2. Jurisdiction
All business conducted directly with the Company or via its website shall be governed by English law. These Terms shall be construed in accordance with English law and fall under the exclusive jurisdiction of the English Courts.
3. Delivery Charges
- All orders will attract a carriage charge, with additional charges for deliveries outside the UK Mainland or requiring overnight or special terms.
- Deliveries aim to be completed within 5 working days, subject to stock availability. If items are out of stock, you will be informed of the approximate delivery date.
4. Delay in Delivery
The Company disclaims all liability for delays caused by events beyond its reasonable control, including but not limited to: war, terrorism, natural disasters, government actions, or shortages. Delivery dates are estimates and cannot be guaranteed.
5. Prices
- Prices are displayed in GBP Sterling and are inclusive of VAT unless otherwise stated.
- The Company reserves the right to amend prices at any time without prior notice.
6. Passing of Title
All goods remain the property of the Company until full payment is received. The Company reserves the right to repossess unpaid goods following written notice.
7. Loss/Damage in Transit
Claims for damage or loss must:
a) Be reported in writing to both the carrier and the Company within 3 days of delivery.
b) Be detailed in a written claim submitted to the Company.
The Company’s liability is limited to replacing damaged or lost goods up to the delivery point.
8. Payment
Payments can be made via Visa, Mastercard, Solo, or Switch/Maestro cards over the phone or through pro forma invoices for cheque or BACS payments.
9. Termination
The Company reserves the right to terminate a contract if the Buyer fails to take delivery or defaults on payment.
10. Manufacturers Warranty
The Company does not guarantee the goods’ merchantability or fitness for any purpose. Defective goods must be reported immediately and returned upon request for evaluation.
11. Descriptions and Dimensions
The Company ensures all advertised items are accurately described; however, descriptions, dimensions, and illustrations are approximate and do not form part of the contract. Errors or omissions on the website will not hold the Company liable.
